The Impact of This Actual Vote Analysis

This analysis provides evidence that the 321,502 votes from the North Carolina March 5, 2024 Primary Election that it analyzed were reported correctly. 

This evidence is:

  • Independent: it comes from a source other than election officials
  • Trustworthy: anyone can verify it, since it requires only publicly available poll tape data and official results data
  • Non-partisan: Actual Vote is open to all users regardless of their partisan leanings, and functions only to contribute to our knowledge about the truth—whatever it may be—around the accuracy of the vote reporting. This is inherently non-partisan

This evidence becomes a new addition to the pool of already-available evidence about the processes and outcome of this election, such as official reports and self-audits from election officials. In this way, this Actual Vote Analysis has increased election transparency.

Election transparency refers to the extent to which the individual procedures of an election are open to scrutiny and receive legitimate independent audits. In a highly transparent election, each process is independently audited, meaning that voters have a strong shared evidentiary basis upon which to formulate a belief about the accuracy of the election. Actual Vote independently audits just the process of vote reporting—namely, everything starting from when the votes are tabulated and ending when the official results are reported. All of the other election processes should also receive independent audits, but this would require tools other than Actual Vote.

Increasing election transparency, like we have done with this Actual Vote Analysis, strengthens democracy by increasing the extent (on average) to which reasonable people can agree that the election in question properly realized its goal of expressing the will of the people.

At America Counts, we use social well-being (SWB) as abstract measure of the extent to which a group of people (US residents, in this case), as a whole, is thriving or suffering. Rancorous disagreement about whether a given election was free and fair (caused in part by lack of transparency) decreases SWB. This Actual Vote Analysis, on the other hand, has strengthened democracy, which most people would agree increases SWB.

This analysis was completed before the election certification date. This means that had we found any apparent discrepancies in vote reporting, we would have been able to escalate them to get them explained or corrected before it was too late. This is powerful, because it shows that this analysis could have helped to improve election accuracy (in addition to election transparency) were it required.

Quick Overview of Methodology

An Actual Vote Analysis is a comparison of values transcribed from poll tapes to the corresponding officially reported results as an independent double-check of the accuracy of the vote reporting. 

For the United States, America Counts defines the scope of an Actual Vote Analysis as any vote reporting in one specific election for one specific state. An Actual Vote Analysis typically covers multiple counties in that state, and multiple (if not all) precincts from each of those counties. A different election in the same state, or a different state in the same election, are each considered a separate analysis and would get separate results pages. The scope of the Actual Vote Analysis on this page is given by the Scope box above.

In North Carolina, officially reported results from an election are given in a format that can be easily transformed into one row per combination of County, Precinct, Voting Method, Contest, and Choice, with a single Officially Reported Vote Total for that combination. The four possible values for Voting Method are Election Day, Early Voting, Absentee, and Provisional.

In some cases in certain North Carolina counties, Early Voting, Absentee, and Provisional votes may be reported in different ways that are not directly at a Precinct level. The methodology presented here gets adapted to work in essentially the same way in these cases, so we don’t go into further detail here. Meanwhile, it seems that Election Day votes are always reported directly at a Precinct level.

Each printed results poll tape from that election in North Carolina represents one specific triple of County, Precinct, and Voting Method, and gives tabulated Poll Tape Vote Totals for in-scope Contests and Choices for that triple. In North Carolina, we have been told that it will always be one tabulating machine per triple, so we never have two or more tabulating machines for one triple each producing its own tape. If we did have that situation, we’d have to add up the corresponding Contest and Choice values for each poll tape from a given County-Precinct-Voting Method triple.

In an Actual Vote analysis, we say that one submission is the set of all videos and/or pictures submitted through the Actual Vote app and/or sent directly to America Counts that contribute to depicting one specific thing. This thing is most often a single Results Tape or a single Zero Tape, but it could also be a Configuration Report, a photo of part of the polling place closing procedure, and so on. Recordings for the purpose of practicing using Actual Vote are not counted as submissions. If a recording features two poll tapes instead of one, we count that as two submissions (though we ask users to stick to one poll tape per recording when possible). A submission may not depict all values on a poll tape that it was intended to document, since some values on the recording may be too blurry to read, or part of the poll tape is obscured.

We say that a transcribable submission is a submission (or excerpt from a submission, or combination of multiple submissions) that depicts one specific results tape, has state, county, election date, voting method, and precinct clearly readable in the header (so we know what official results to compare it to) and contains at least one legible contest/choice/vote total triple for us to transcribe. and compare to the officially reported results.

Submissions containing zero tapes or configuration report tapes are not transcribable because they don’t contain any vote totals that can be compared against the officially reported results. Actual Vote users are free to record zero tapes with the app if they wish, but valid zero tapes (ones that correctly show zero votes in all vote total fields) can’t tell us anything about the vote reporting process itself. Meanwhile, in the exceedingly rare case that 

A submission containing a summary report tape with vote totals aggregated at a high level can sometimes be compared to officially reported totals, depending on what specific information it contains. If such a submission can be analyzed in a reasonable amount of time and gives useful information about vote reporting, America Counts will classify it as a transcribable submission. Otherwise, we will classify it as a not-practical-to-transcribe submission.

We transcribe Poll Tape Vote Totals for each Contest and Candidate on each transcribable submission. In practice, many transcribable submissions are simply a well-composed and well-focused video-recording from the Actual Vote app that clearly depicts the entire poll tape from top to bottom, making the values easy to transcribe. In other cases, a transcribable submission might consist of a handful of hard-to-transcribe photographs taken as best as the user could during the polling place closing procedure.

The poll tape transcription for the analysis on this page was done by hand on a highly-structured Google Sheet.

In a given county, the number of transcribable submissions per Voting Method we have is a good measure of the extent to which Actual Vote is double-checking the vote reporting in that county. For example, if we get one transcribable submission for election day votes from each precinct in a county, we can do a complete audit of the election day vote reporting in that county.

County-Precinct-Voting Method-Contest-Choice-level Poll Tape Vote Totals transcribed from transcribable submissions can each be compared directly to the corresponding number in the Official Results. If the totals don’t match, the value is marked as an apparent discrepancy. In practice, the ingesting and pre-processing of the Official Results and the Poll Tape Transcriptions, as well their direct comparison, is done using Python, an industry-standard programming language for data science. It also produces the summary results shown on this page. 

An Actual Vote Analysis has two possible Analysis Windows: before the election certification date and after the election certification date. In both cases, our independent audit of vote reporting increases election transparency. But if all submissions are received and all analysis is completed in the before election certification date Analysis Window, any apparent discrepancies we find can be escalated to the relevant County election administrators or further while it’s still possible to update the official reporting if it is warranted. This outcome would mean an improvement in election accuracy.

On the other hand, the evidence from an Actual Vote Analysis whose Analysis Window is after the election certification cannot change the already-certified results. But such an analysis is still of interest, as it does give information about the state of vote reporting in the areas that it  covers, which increases election transparency.

Other data for this report was obtained by users using the ordinary camera app on their device to take videos or photographs of poll tapes in situations where they have permission to do so, and sending them to America Counts via email, DropBox, or other ways.

This report was issued four days before the certification date for this election, March 15, 2024. During that time window, any evidence of apparent discrepancies that may have been uncovered could have been escalated to be explained by election administrators. In the rare case that no satisfactory explanation was given, the evidence could have been used in a legal challenge to the official results.

Now that the certification date for this election has passed, this report can be used in two ways:

  • As independent evidence of the state of transparency and accuracy of vote reporting in its constituent counties during the March 5, 2024 North Carolina Primary Election
  • To help plan Actual Vote projects for future elections in North Carolina

While the data and analysis contained herein may be suitable for other purposes, no such suitability is expressed or implied by America Counts.

This report depends on information about how vote reporting works in North Carolina and in this report’s constituent counties. Much of this information we have directly verified on the appropriate election websites or by speaking directly to election administrators.

But it is infeasible to confirm all such information directly with the respective Boards of Elections or NCSBE. This means that there is some such information in this report necessarily reflects educated guesses and inferences by America Counts based on resources we found online, on poll tapes, and from our pre-existing knowledge about elections and vote reporting in general. Therefore, although we are reasonably sure that such information is accurate, we cannot fully guarantee its accuracy.

This means that if you wish to use this report, you are advised to proceed with the appropriate level of caution.

To the contrary—our vote reporting activities are motivated only by the following:

  • US elections are vulnerable to error and fraud
  • Independent audits of high-stakes systems like elections are critical no matter how well the people in that system are performing
  • In many states, US elections don’t receive sufficient independent audits
  • Election transparency is critical

Discussion of Results

No Apparent Discrepancies Found

As mentioned above, this analysis provides evidence that the 321,502 votes from the North Carolina March 5, 2024 Primary Election that it analyzed were reported correctly. The implications of this for election transparency were also discussed above.

Our users showed exemplary professionalism and perseverance in recording poll tapes under conditions that sometimes were quite challenging. We appreciate everyone’s hard work and dedication to election transparency. We also thank the organizations that provided organizational support.

External Challenges to Using Actual Vote in the Field

Some Actual Vote users were told that they were not allowed to use the Actual Vote app to video-record poll tapes, but that they could take videos or pictures with their phone’s camera app. Many users emailed us transcribable submissions this way, which is great. But using the app results in the same data going into the analysis, and is much faster. Forbidding the use of the app only has the effect of slowing down the analysis process. America Counts encourages North Carolina election administrators to allow the use of the Actual Vote app to video-record poll tapes, since vote report auditing with Actual Vote helps to improve election transparency.

Some users whose only option was to take still photos of poll tapes opted to use Panoramic Mode on their device. Unfortunately, this can result in blurry, cut-off, and hard-to-transcribe photos. America Counts encourages users in this situation to use the normal camera mode, and take as many clear, well-aligned shots as it takes to document the whole poll tape, and send us all of the pictures.

Some users had to record under very challenging conditions, including trying to squeeze in a recording under an ongoing flurry of polling place closing procedures. These recordings were understandably a bit blurry, but many of them were clear enough to transcribe (with some effort)+. This illustrates that it’s worth the user effort and perseverance to try to record poll tapes under challenging conditions, since they can be incorporated into the analysis even if they happen to be hard to transcribe.

Note About Non-Transcribable Submissions

We received a handful of great submissions showing polling place closing procedure and tabulation procedure. We love to get these, since they show the real-world side of the Actual Vote process, which can be kind of abstract. 

We also received a fair number of submissions featuring zero tapes, configuration reports, and other such things. As noted above, we welcome receiving these, but users should be aware that they don’t go into the final analysis since they don’t contain voting results.

Issue With AM/PM Setting in Tabulators

While Actual Vote Analyses are mainly focused on auditing vote reporting, analyzing poll tapes can reveal apparent anomalies in vote reporting procedure as well. While such anomalies may not be directly relevant to the outcome of the election, America Counts still raises them with the relevant supervisors of elections in case they could enable such anomalies to be corrected for future elections.

This is important for two reasons. First, it alerts us that we should give the vote totals from poll tapes with apparent anomalies extra scrutiny when comparing to the official results, in case the existence of apparent anomalies in procedure increases the probability of finding apparent discrepancies in the vote total comparison. Second, apparent anomalies in procedure indicated on a poll tape could enable someone to call valid vote total evidence from that poll tape into question for preventable and irrelevant reasons, which we’d like to avoid.

In this analysis, we discovered such apparent anomalies in the opening and closing timing on the results poll tapes from two precincts in Henderson County, Laurel Park and Flat Rock:

As you can see, these tapes seem to be indicating that the polling places in these two precincts opened after six o’clock in the evening (an hour and a half before official closing time) and stayed open until after seven o’clock the next morning. Of course, it’s almost certain that what really happened was simply that AM/PM was set backwards on these two specific tabulating machines, and that these two polling places had totally normal hours—opening a bit after six o’clock in the morning and closing a bit after 7:30pm. 

We informed the Henderson County Board of Elections of this apparent anomaly via email on March 11, 2024. They replied within hours, confirming that the AM/PM setting on the tabulators had indeed been inadvertently set incorrectly. They thanked us for catching this and pledged to address this issue for the next election. This response resolves this issue in a satisfactory way.

America Counts thanks Henderson County Board of Elections for their professionalism in taking time to help us resolve this issue. America Counts is committed to respecting Boards of Elections’ time by limiting our requests to just those questions about poll tape procedure or outcomes that are relevant to vote report auditing with Actual Vote, and that only they can answer.

America Counts also thanks poll workers in Laurel Park and Flat Rock for their hard work and service in this election, and understands that election day is a long day for them, full of many procedures to follow. So we want to be clear that America Counts raises this AM/PM issue not to specifically call them out, but rather in the spirit of teamwork and commitment to free, fair, and transparent elections.

As you can see, this issue with AM/PM is easily resolvable and not directly relevant to the outcome of the election. But if other evidence on these poll tapes raised critical questions relevant to the outcome of the election, this AM/PM issue could become a preventable and irrelevant distraction, which we’d like to avoid. So all participants in this Actual Vote Analysis can be proud that in addition to providing independent evidence that the in-scope vote reporting was done correctly, the evidence they gathered also contributed to helping to improve the accuracy with which tabulators are initialized.
